• Legal relationship

  • Your access and use of the Our Childcare website constitutes your agreement to be bound by the Terms.
  • Our Childcare provides a technology platform to enable users of its website to arrange and schedule childcare with independent 3rd party providers (“Services”).
  • The Services are made available to persons over the age of 18 years solely for their personal, non-commercial use and are provided by independent 3rd party contractors who are not employed by Our Childcare.
  • Our Childcare accepts no liability for the provision of the Services by the independent 3^rd party provider, including but not limited to the qualifications of the independent 3^rd party provider to undertake childcare, the suitability/safety of the location to provide childcare or the performance of the Services.
  • Our Childcare reserves the right to review and change any of the Terms by updating this page at its sole discretion at any time. Any changes to the Terms will take effect immediately from the date of the publication. Your continued use of the website or the Services after the posting of such revisions will constitute your acceptance of the revisions.

• Payment
  • Payment for the Services is required in advance (“Charges”) after which Our Childcare will send you a receipt by email in the name of the individual independent 3rd party provider.
  • Our Childcare will facilitate your payment of any applicable Charges on behalf of the independent 3rd party providers, as their limited payment collection agent.
  • Such payment will be considered the same as payment made directly by you to the 3rd party provider.
  • Our Childcare does not provide the Services but is entitled to charge a transactional fee (“Transactional Fee”) for introducing you to the independent 3^rdparty provider.
  • The Transactional Fee is included in the Charges and is paid for by the independent 3^rd party provider to Our Childcare.
  • Our Childcare reserves the right to establish, remove and/or revise the Charges for the Services.

• Refund Policy
  • At Our Childcare we provide a service for parents.  If the service at any time is not provided or the customer changes their  mind before the service is provided  a full refund will be granted.

• Risk Assumptions and Precautions
  • Our Childcare does not “vet” or approve each independent 3^rd party provider as qualified and/or suitable for providing the Services, as this will always remain your responsibility.
  • You assume all risk when using the Services, including but not limited to all the risks associated with interactions between the independent 3rd party provider and the children under their care and control.
  • You agree to take all necessary precautions when communicating with or meeting independent 3rd party providers to ensure such providers hold appropriate legal qualifications for childcare and the premises at which the children will be cared for comply with all necessary legal statutory requirements to ensure the maximum safety of the children.
  • You understand that Our Childcare makes no representations, warranties or guarantees, either express or implied, regarding your (or your children’s) ultimate compatibility with any independent 3rd party provider or the manner in which they will provide those services and/or relate to such children.
• Insurance
• Our Child Care provides insurance for carers registered with and approved by Our Child Care, subject to special terms and conditions. Please contact Our Child Care to clarify these terms and conditions.

• Disclaimer
  • Our Childcare does not grant any warranty of any kind, whether express, implied, statutory or otherwise with respect to the Services or its website

• Limitation of Liability
  • To the extent permitted by law, Our Childcare will not be liable for any incidental, special, consequential or indirect damages arising out of or relating to the Services.
  • You understand that we are not a party to and will not have any liability with respect to your engagement with any independent 3rd party provider. Any claims you have arising out of the Services are to be brought against the independent 3rd party provider and you agree to indemnify Our Childcare from all claims, suits, demands and legal actions arising from any and all disputes between yourself and any independent 3rd party provider.

• Governing Law

  These Terms are governed by the laws of the State of Victoria.

• Relationship

  Nothing in these Terms is intended to create a partnership, joint venture, agency or employment relationship with either yourself or the independent 3^rd party provider.
